New Federal Filing Seeks $20M From The Preserve and Paul Mihailides

In a new filing in federal court filed by Alison McDaniel against The Preserve at Boulder Hills, MTM Development and Paul Mihailides, McDaniel is now seeking $20 million for punitive damages, back wages, pain and suffering, and more. 

The latest filing is on an underlying suit alleging sexual harassment and more, but now, there are additional claims — and the stakes are much higher.

GoLocal was the first to report the initial lawsuit McDaniel filed in July of 2023.

Since then, there have been charges and countercharges by the attorneys.

And, more women have come forward with allegations.

In November, Mihailides, the CEO of The Preserve Sporting Club, was hit with another lawsuit by a woman alleging a hostile work environment tied to sexual harassment, discrimination based on sex quid pro quo sexual harassment, discrimination based on sex — disparate treatment, and other claims.

The five-count complaint was filed in Rhode Island Superior Court.

Besides, Mihailides, also named in the suit, is the company that does much of the construction at The Preserve and, according to Rhode Island business records, is controlled by Mihailides — M.T.M. Development Corporation.

The woman filing that suit, Heidi Grant, worked for M.T.M.

It was the second lawsuit filed by a woman against Mihailides in a five-month span.

 

McDaniels Seeks $20 Million

According to this filing, McDaniels is seeking not only unpaid wages but also $20 million in total damages and penalties.

McDaniel's attorney Mark Gagliardi told GoLocal that the amended complaint and damages sought arose from the actions of the defendants.

"It's [their] counterclaims that we feel are retaliatory," said Gagliardi. "They were aware of the alleged facts giving rise to their counterclaims back in February of 2022."

The new amended complaint in federal court seeks the following:

- An order directing Defendants to take such affirmative action as is necessary to ensure that the effects of these unlawful employment practices are eliminated and do not continue to affect Plaintiff’s employment opportunities;

- An award of unpaid wages in the amount of $106,063;

- An award of liquidated damages pursuant to R.I. Gen. Laws § 28-14-19.2 equal to two times the amount of wages owed in the amount of $212,126;

- Impose a civil penalty in the amount of $3,000 pursuant to R.I. Gen. Laws § 28-14-19.1(b) to be shared equally between Plaintiff and the Rhode Island Department of Employment and Training.

- An award of  $1,100,000 for emotional pain and suffering;

- An award of  $1,000,000 for damage to reputation;

- An award of  $18,900,000 for punitive damages;

- An award of treble damages for Plaintiff’s damages for injury or loss.
