RI State Police Investigation Into Guilmette Began in 2020

Guilmette, age 43, is facing a series of new charges after an investigation that began two years ago -- an investigation sparked initially by a Rhode Island State Police (RISP) informant.

RISP documents secured by GoLocal via an Access to Public Records Act (APRA) request outline how an informant tipped off the State Police -- and how an investigation by the RISP has led to a series of felony charges.

This case has been two years in development and is now pending in Rhode Island Superior Court.

The criminal information — signed by Assistant Attorney General Joseph McBurney and officially submitted to Providence Superior Court on July 18, 2022 — names Guilmette in ten counts stemming from an alleged offense date of November 10, 2021.

Two of the counts ultimately were not charged; one of the remaining counts was a misdemeanor, and the other seven were felonies.

The felony charges allege that Guilmette unlawfully delivered a controlled substance — Lorazepam — in violation of state law; that he conspired to violated the state’s Uniformed Controlled Substances Act by agreeing to deliver a controlled substance (Lorazepam); that he “did knowingly make a false material declaration” to Rent Relief RI in violation of state law; that he conspired to commit an unlawful act in violation of state law; that obtained money over $1,500 from Rent Relief RI by false pretenses; that he conspired to obtain the money under false pretenses; and that he conspired to give false documentation to an agent of Rent Relief RI in violation of state law.

According to court documents, a pre-arraignment conference is scheduled for October 2022, and a pre-trial conference is scheduled for January 2023.

The State Police documents obtained by GoLocal outline court-ordered wiretaps, no-knock home invasions, and a range of alleged crimes.

“During the month of July of 2020, I, Detective [Matthew] Lynch received information from a previously reliable confidential source, hereinafter referred to as Source One, and in the masculine gender, to protect his or her identity. Source One has never provided me with information that has proven to be false. Furthermore, information from Source One has previously led to the successful arrests and prosecutions of several individuals involved in illegal organized criminal gambling operations in the State of Rhode Island. Source One advised that he received first-hand information regarding an individual known to him as "Dino Guilmette," and stated that "Dino Guilmette" was presently selling large quantities of cocaine, believed to be in kilogram quantities, in the State of Rhode Island. For the duration of this narrative, it should be noted that all confidential sources identified positively identified "Dino Guilmette" by his Rhode Island license photograph as Dino GUILMETTE; REDACTED [GoLocal is not reporting his date of birth or his home address],” according to the State Police narrative by Lynch, according to the State Police.

Alleged Links to the "Patriarca Crime Family"

"During this meeting with Source One, he advised that GUILMETTE was working with an individual positively identified as REDACTED, Rhode Island, in distributing kilograms of cocaine. Source One advised that GUILMETTE and REDACTED were believed to be smuggling kilograms of cocaine into the State of Rhode Island from an unknown Caribbean island. Source One also advised that this operation, which was purportedly overseen by GUILMETTE, was done so in furtherance of GUILMETTE's affiliation to the New England Organized Crime Family, also known as the "Patriarca Crime Family," and hereinafter referred to as the NELCN, the "New England La Cosa Nostra," states the RISP document.

"Furthermore, Source One advised that GUILMETTE was responsible for this organization under the authorization of Matthew Guglielmetti, REDACTED. Matthew Guglielmetti is known by members of the State Police Intelligence Unit as a "Capo" or "Capo Regime" within the NELCN. Finally, Source One also advised that GUILMETTE, at this time, was using telephone number REDACTED, hereinafter referred to as Target Telephone I, as a means to communicate with individuals in furtherance of his illegal activities," according to the State Police.

According to a report by CBS News, Gugliemetti ran the New England Crime family for a number of years.

According to RISP documents,  "Upon acquisition of this information, I [Detective Lynch] made contact with personnel at the Drug Enforcement Administration (DEA) - Providence Field Office, and acquired cellular telephone records relating to Target Telephone I. I examined these records which confirmed that GUILMETTE was in contact with both REDACTED and Matthew Guglielmetti consistently during this time period. Additionally, GUILMETTE had been in contact with numerous telephone numbers believed to belong to individuals with narcotics related criminal histories as well as individuals with known allegiances to the NELCN."

Multiple Sources Corobrate, "Affiliation with New England La Cosa Nostra"

The RISP document by Lynch further states, "I began to conduct intermittent surveillance of GUILMETTE in furtherance of this information. While doing so, I determined that GUILMETTE appeared to be a surveillance conscious individual who, from my opinion, was savvy in his movements and his actions. From this time to August of the year 2021, I, along other members of the State Police Intelligence Unit received information from three additional confidential sources. These sources will hereinafter be referred to as Source Two, Source Three, and Source Four. The cumulative results of these meetings from these confidential sources provided further support that GUILMETTE uses Target Telephone I to communicate with individuals in furtherance of his criminal activities. This source information also shed light on GUILMETTE's involvement in the sale of cocaine as well as his affiliation with the NELCN."

"In August and September 2021, I, along with members of the Intelligence Unit met with a fifth previously reliable confidential source hereinafter referred to as Source Five, and in the masculine gender, to protect his or her identity. Source Five has never provided me with information that has proven to be false. Furthermore, information from Source Five has previously led to the successful arrest of an individual in possession of large quantities of illegal narcotics. Source Five advised that GUILMETTE was, at this time, involved in a large-scale cocaine smuggling and distribution operation. Source Five believed that GUILMETTE was importing large-quantities of cocaine into the State of Rhode Island. Source Five advised that GUILMETTE was using Target Telephone I to orchestrate this operation. Source Five advised that GUILMETTE was responsible for this operation under the approval of Matthew Guglielmetti, and that GUILMETTE was allegedly paying Mathew Guglielmetti with proceeds from his cocaine sales to demonstrate his allegiance to the NELCN," according to the RISP.

"Source Five positively identified REDACTED as an individual involved in GUILMETTE's operation. Additionally, Source Five positively identified two individuals, REDACTED and REDACTED, as two individuals working with GUILMETTE to import and sell cocaine. Another examination of the telephone records for Target Telephone I at this time determined that GUILMETTE was again in contact with phone numbers belonging to Guglielmetti, REDACTED as well as REDACTED and REDACTED. Additionally, GUILMETTE was also in frequent contact with individuals with narcotics related criminal histories as well as suspected telephone numbers belonging to individuals with affiliations to the NELCN," according to the State Police.

"Source Five also advised that he could purchase cocaine directly from GUILMETTE. During the months of September and October 2021, at my direction and supervision, Source Five completed two (2) controlled purchases of cocaine from GUILMETTE. The terms and conditions of these controlled cocaine purchases were negotiated through communication between Source Five and GUILMETTE over Target Telephone I," according to the State Police.

GoLocal spoke with Guilmette and he said he had "no comment" on the State Police investigation

Judge Gibney Authorizes Wiretap

"Given the totality of this information, surveillance, various investigative techniques used to this point, as well as the controlled narcotics purchases, I, along with the Intelligence Unit, as well as the Attorney General's Office for the State of Rhode Island agreed that the most advantageous method to investigate the full-scope of GUILMETTE's operation was to intercept wire, electronic, and oral communications conducted over Target Telephone I. On October 29, 2021, I, along with the assistance of the Attorney General's Office prepared and submitted an Affidavit, Application, and Order to intercept wire, electronic, and oral communications conducted over Target Telephone I (REDACTED). The Honorable Alice B. Gibney, Presiding Justice of the Superior Court, reviewed these documents and subsequently authorized the wiretap investigation. The authorized agencies for this wiretap investigation were the Rhode Island State Police, the DEA, and the United States Marshal's Service. Members of the Intelligence Unit executed this order with AT&T, the identified carrier of Target Telephone I, and this wiretap successfully commenced on October 30, 2021," wrote Lynch.

WhatsApp

"During interception of Target Telephone I, investigative team members determined that this device, used by GUILMETTE, was an iPhone, and GUILMETTE was believed to be using iMessaging to communicate with individuals. This form of communication provides its users with end-to-end encryption protection and therefore, the contents of these text messages was not able to be furnished to members of the investigative team. Furthermore, personnel from the DEA determined that GUILMETTE has downloaded the "What’s App" application on his cellular telephone device. The "What’s App" [WhatsApp] application provides its users with end-to-end encrypted text messages and phone calls that are not able to be furnished through a traditional wiretap used in this investigation. Specifically citing these hindrances, an Order to terminate interception of wire, electronic, and oral communications over Target Telephone I was authorized executed on November 26, 2021," according to RISP.

Alleged Rent Relief Fraud

The State Police stated in its documents, "Despite this, during interception of Target Telephone I, members identified numerous communications between GUILMETTE and his associates that appeared suspicious and criminal in nature. A series of these communications that were intercepted were between GUILMETTE and a female subject positively identified as REDACTED, Members intercepted several conversations between GUILMETTE and REDACTED relative to their combined efforts to obtain past due and future rent ($7,000 in US currency) owed to GUILMETTE by REDACTED, his tenant, that she appeared to have already paid."

Search Warrant Issued

According to the State Police documents, "During interception of Target Telephone I and following its termination, I, prepared search warrants to obtain access to GUILMETTE's email history and banking history to expose further information relative to these suspected crimes (see Exhibit No. 8 Guilmette Yahoo Search Warrant & Exhibit No. 9 Guilmette Bank REDACTED Search Warrant). Presiding Justice Gibney reviewed and authorized each of these search warrants and they were subsequently executed accordingly. The totality of this information confirmed that a suspected phony application and claim was made collectively by GUILMETTE and REDACTED to obtain $7,000 in United States currency from Rent Relief RI, an agency designed to assist landlords and tenants with rent payments due to the burden of the Covid 19 pandemic."

"In order to fully investigate and ultimately charge these crimes, it was determined that a physical copy of the application collectively submitted by GUILMETTE and REDACTED would be required in order to identify their lease agreements and other documents supporting their suspected illegal conspiracy. I made contact with personnel from Rent Relief RI and was informed these documents could be furnished to members of law enforcement; however, personnel could not guarantee that GUILMETTE and REDACTED would not be notified of this investigation. This information proved troubling as the authenticity of this investigation would be compromised and the possibility that GUILMETTE and REDACTED could destroy evidence and/or attempt to communicate and plan an alibi to their suspected illegal activities would be imminent," Lynch continued.

Then, according to RISP's Lynch, "Therefore, on December 13, 2021, I prepared search warrants for GUILMETTE's residence, person, and vehicle to search for any and all documents as well as digital media in support of these suspected crimes (REDACTED Guilmette Physical Search Warrant). On this same date I also submitted search warrants related to REDACTED residence, person, and vehicle (see Exhibit No. 15 REDACTED Physical Search Warrant). During interception of Target Telephone I, a confidential source, at my direction, made two (2) controlled purchases of cocaine directly from REDACTED after he left directly from his residence located at REDACTED. Presiding Justice Gibney again reviewed and authorized each of these search warrants."

"The next morning, on December 14, 2021, members executed simultaneous search warrants at both GUILMETTE's and REDACTED residences. Both subjects were located inside their respective residences and the Court-authorized searches ensued. At the outcome of these searches, members seized numerous documents and pieces of digital media from GUILMETTE's residence, which included Target Telephone I. GUILMETTE was not immediately arrested at the outcome of the search. Members assigned to the REDACTED search warrant arrested REDACTED after this search produced a distributable quantity of cocaine accompanied by a large-quantity of United States currency and four (4) firearms (REDACTED)," according to RISP.

"Following these search warrants, which did not produce the sought after Rent Relief RI application and claim information, I again made contact with personnel from this agency and requested this information be furnished as the need for a non disclosure was no longer necessary. Shortly thereafter, I was provided with the requested documents pertaining to GUILMETTE's and REDACTED's application to Rent Relief RI. I subsequently reviewed these documents which outlined a “month to month” agreement between REDACTED and GUILMETTE of one thousand dollars ($1,000) per month for her rent bill. Again no formal lease was provided to verify this information," wrote RISP.

"REDACTED also claimed that she did not qualify for unemployment benefits and indicated this accordingly on this application. During interception of Target Telephone I, conversations were intercepted by members of the investigative team that REDACTED was lying to the State of Rhode Island about her marital status to acquire more money which she in turn was using to pay GUILMETTE her rent. Within the contents of this information supporting this claim was a certification page that was signed by both GUILMETTE and REDACTED. Above both of these signature lines, both individuals affirmed that the contents of the information provided to 'Rent Relief RI' was truthful and accurate: “Under the penalty of perjury, I certify that the information presented in this certification is true and accurate to the best of my knowledge. I further understand that providing false representations constitutes an act of fraud. False, misleading, or incomplete information may result in the repayment of any funds received through RentReliefRI and other remedies available under applicable law.”

"This evidence produced probable cause to arrest GUILMETTE and REDACTED on charges of 1) Obtaining Money Under False Pretenses Over $1,500, 2) Conspiracy to Obtain Money Under False Pretenses Over $1,500, 3) Perjury, 4) Conspiracy to Commit Perjury, 5) Giving False Documents to Agent, Employee, or Public Official, 6) Conspiracy to Give False Documents to an Agent, Employee, or Public Official."

Drugs and Wiretaps

According to State Police documents, "Separate and apart from this avenue of the GUILMETTE investigation, I, along with members of the Investigative Team also launched an investigation into GUILMETTE's involvement selling prescription pills. Upon conclusion of the physical search warrant conducted at 49 Lincoln Park Avenue, Cranston, Rhode Island, Target Telephone I was seized as well as a second cellular telephone device that belonged to GUILMETTE. Verbiage within the Search Warrants for Guilmette’s residence, person, and vehicle granted members of the State Police to seize and examine any and all digital media in support of the sought after criminal charges of Obtaining Money Under False Pretenses Over $1,500 and Conspiracy to Obtain Money Under False Pretenses Over $1,500. I, along with personnel from the State Police Computer Crimes Unit, examined the contents of Target Telephone I and located text messages within this device between GUILMETTE and several individuals that appeared to be related to narcotics activity. Given this, I ceased any further examination of these cellular telephone devices. I prepared two (2) additional Search Warrants to examine these devices for evidence of crimes related to illegal narcotics transactions and narcotics related activity. These Search Warrants were submitted to the Honorable Judge Stephen Isherwood of the District Court, which he reviewed and authorized REDACTED."

In addition, the State Police stated, "I again re-examined the contents of Target Telephone I and located a text message conversation between GUILMETTE and an individual identified in GUILMETTE’s contact list as “REDACTED” under telephone number (401) REDACTED. During interception of Target Telephone I, members of the Investigative Team positively identified the owner of this cellular telephone number as REDACTED, hereinafter referred to as REDACTED. REDACTED was intercepted speaking with GUILMETTE over Target Telephone I while using this cellular telephone number. During interception of Target Telephone I, members of this Investigative Team identified REDACTED  as the girlfriend of REDACTED."

Further, according to RISP, "As previously mentioned, on December 14, 2021, members of the State Police executed a Court-authorized search warrant at REDACTED, Rhode Island simultaneously to the Search Warrant at GUILMETTE’s residence. While searching this residence at REDACTED, members of the search team located a dresser in the master bedroom of the residence. In the top left drawer of this dresser, members located a prescription pill bottle for Lorazepam (Schedule IV controlled substance) in the name of “Dino Guilmette”. This pill bottle, authorized for ninety (90) pills, was over half-way empty. Directly next to this pill bottle members located a black cellular telephone. Members questioned REDACTED and REDACTED about these pills and this phone. REDACTED told investigators that the cell phone was hers. REDACTED also told investigators that the Lorazepam pills were left in her vehicle by GUILMETTE, and she was holding on to them so they could be returned to him. Simultaneous to this, while at Guilmette’s residence, I located another near full prescription pill bottle (90 pill count authorization) for Lorazepam in GUILMETTE’s name, which was located inside his vehicle."

"Search team members from REDACTED seized the Lorazepam pill bottle and transported this evidence to State Police Headquarters. Upon arrival, these pills were counted (thirteen full pills and numerous broken/crushed pills) and weighed (5.2 grams). These pills were then transported to the Rhode Island Department of Health Toxicology Lab for submission and testing. Soon thereafter, I received these test results from the Toxicology Lab, which confirmed the presence of Lorazepam," according to RISP.

Following receipt of this evidence, as well as the permission granted by the Court to search Guilmette’s cellular telephone device for evidence of narcotics activity, I reverted back to the text message contents between GUILMETTE and REDACTED. On November 10, 2021, at approximately 2:42 PM, REDACTED sent a text message to GUILMETTE, “Can you bring me some Ativan tonight?”. On this same date at approximately 2:43 PM, Guilmette responded, “Yes”. During interception of Target Telephone I, members of the Investigative Team conducted physical surveillance of GUILMETTE on November 10, 2021, which included his attendance at the Toscan Social Club located at 68 Spruce Street, Providence, Rhode Island. During interception of Target Telephone I, members of the Investigative Team became aware of a recurring card game involving GUILMETTE, REDACTED, and numerous other individuals at the Toscan Social Club on Wednesday nights REDACTED.

"On this evening, GUILMETTE, REDACTED, along with REDACTED, were physically observed at the Toscan Social Club by members of the Investigative Team. The next day, members of the Investigative Team intercepted communications over Target Telephone I involving these three individuals where they discussed socializing the night of November 10, 2021 (REDACTED). Additionally, on December 7, 2021, your Affiant located additional text messages between REDACTED and Guilmette preserved on Target Telephone I. Specifically, on this date at approximately 8:14 PM, REDACTED sent two text messages to GUILMETTE, “Love you more” and “Especially as I’m taking one of your sleepers right now lol”. On this same date at approximately 8:15 PM, GUILMETTE responded to these text messages with a text message photograph [emoji] of a smiling face," according to the State Police.

Schedule IV Narcotic

According to the State Police, "Lorazepam also commonly referred to as "Ativan" belongs to a class of drugs known as Benzodiazepines which is a Schedule IV narcotic that must be prescribed to treat Anxiety. A common side effect from Lorazepam (Ativan) is drowsiness. Therefore, when REDACTED stated, “Especially as I’m taking one of your sleepers right now lol”, it is believed that she had just ingested a quantity of Lorazepam (Ativan) that she obtained from GUILMETTE that is making her tired. Given these findings, I applied for additional charges of Delivery of a Controlled Substance – Schedule IV, and Conspiracy to Violate the Uniform Controlled Substances Act for GUILMETTE as well as charges of Conspiracy to Violate the Uniform Controlled. Presiding Justice Gibney reviewed these arrest warrants as well as the arrest warrant for REDACTED and authorized each of these arrests."

"On Friday, February 4, 2022, members of the State Police arrested GUILMETTE at his residence without incident. On this same date, members arrest REDACTED at REDACTED's mother's residence located at REDACTED, also without incident. Members attempted to arrest REDACTED at her residence; however, she was not home at the time. Contact was made with REDACTED and she subsequently turned herself into State Police Headquarters the next day. REDACTED was processed, arraigned by a Justice of the Peace and released on $20,000 Personal Recognizance. GUILMETTE and REDACTED were processed following their arrests and transported to Sixth Division District Court for their arraignments. Both individuals pled Not Guilty at their arraignments. GUILMETTE was released on $5,000 with surety bail and REDACTED was released on $5,000 Personal Recognizance," according to the State Police.

No Knock Warrant, Greeted by a Rottweiler

In another set of RISP documents, the state wrote, "On Tuesday, December 14, 2021, at approximately 5:45 AM, members of the State Police Intelligence Unit, along with members of the Violent Fugitive Task Force, the High Intensity Drug Trafficking Area (HIDTA) Task Force and the State Police Uniform Division executed a Court-authorized search warrant at REDACTED. I, Detective Mathew Lynch, had obtained this Court-authorized search warrant from the Presiding Justice of the Superior Court Alice B. Gibney, which granted members of the State Police to search this residence for documents, in both paper and electronic format, supporting evidence of crimes relating to the obtainment of money under false pretenses as well as conspiracy. The suspect of this investigation had been previously identified as Dino J. Guilmette, REDACTED. Dino J. Guilmette, REDACTED, will hereinafter be referred to as "Guilmette". Additionally, a Court-authorized search warrant was obtained for a white Lincoln Navigator bearing Rhode Island passenger registration REDACTED, which is a vehicle actively registered to and used by Guilmette. Probable cause outlined in these search warrants articulated that Guilmette and a female subject positively identified as REDACTED, were likely conspiring with one another to illegally obtain money ($7,000 in United States currency) from Rent Relief - Rhode Island through a false application collectively submitted to this program."

"On the above date at approximately 5:30 AM, members met for a case briefing in the Cranston, Rhode Island area. Following this, members proceeded to REDACTED and executed this Court-authorized "No Knock" search warrant through the front door of this residence. Members made entry into this residence and located Guilmette standing in a hallway with his hands up. I then ordered Guilmette to the ground where I secured him in handcuffs without incident. Additional search team members conducted a further sweep of this residence, and Guilmette was determined to be alone inside the residence with a Rottweiler. Guilmette's person was searched and he was escorted to a chair in the kitchen area of the residence. I then presented Guilmette with copies of each of the aforementioned search warrants and a search of the residence and vehicle ensued."

"Upon conclusion of this search warrant, members seized numerous items from this residence pending a future investigation. Members were not able to successfully locate any paperwork relating to either Guilmette's or REDACTED application to Rent Relief - Rhode Island. Therefore, during the first two (2) weeks of January 2022, I made contact with Ms. Corinne Myers of the RI Housing Legal Department which handles all matters regarding Rent Relief - Rhode Island. I had previously spoke with Ms. Myers regarding this matter and it was determined that confidentiality of this investigation could not be guaranteed as outsourced personnel would be contacted for any law enforcement-related inquiries. This information was imminent to the decision to search Guilmette's residence in order to ensure that pertinent evidence would not be destroyed. During these communications with Ms. Meyers, a formal request was submitted on behalf of this investigation. Soon thereafter, I was provided with documentation relative to this investigation," stated the RISP documents.

"I reviewed this information, which outlined a “month to month” agreement between REDACTED and Guilmette of one thousand dollars ($1,000) per month for her rent bill. Again no formal lease was provided to verify this information. REDACTED claimed that she does not qualify for unemployment benefits and indicated this accordingly on this application. REDACTED claimed she became unemployed during the month of June 2021 due to the Covid 19 pandemic. False, misleading, or incomplete information may result in the repayment of any funds received through RentReliefRI and other remedies available under applicable law,” according to the State Police.

"Additionally, through Search Warrant compliance with Bank REDACTED, which is Guilmette's banking institution, I determined that on November 29, 2021, seven thousand dollars ($7,000) in United States currency was deposited into Guilmette’s Bank REDACTED checking account, account number REDACTED. This payment was submitted to Guilmette in check form to “Dino Guilmette” from “Yardi Systems Inc – Rent Relief Fund” through this business’s REDACTED checking account, check number REDACTED. I also reviewed the front and back images of this check which displayed a signature from Guilmette endorsing this check. I was also provided with a copy of a deposit slip authored by Guilmette indicating a full deposit of this seven thousand dollars ($7,000) into his aforementioned checking account," the State Police reported.

"I also reviewed the activity from Guilmette’s checking account. I identified another transaction, which occurred the next day, on November 30, 2021, when Guilmette immediately withdrew twenty-five hundred dollars ($2,500) in United States currency from this same checking account. This activity further solidified and supported this criminal conspiracy as REDACTED requested she be provided with a sum of two thousand dollars ($2,000) in United States currency from this seven thousand dollars ($7,000) to which Guilmette agreed. Given the totality of this information, an arrest warrant will be sought for REDACTED on charges of 1) Obtaining Money Under False Pretenses Over $1,500, 2) Conspiracy to Obtain Money Under False Pretenses Over $1,500, 3) Perjury, 4) Conspiracy to Commit Perjury, 5) Giving False Documents to Agent, Employee, or Public Official, and 6) Conspiracy to Give False Documents to Agent, Employee, or Public Official. Additionally, further information relative to Guilmette and REDACTED's scheme to defraud Rent Relief - Rhode Island can be found in this arrest warrant's affidavit.
