195 Commission Refuses to Release Hundreds of Pages of Fane Tower Documents

Fane Tower - pending for more than 4 years

On Friday, the Fane Tower development team submitted approximately 800 pages of documents to the 195 Commission in compliance with a May 15th deadline.

The documents are relevant to the design of the long-delayed and long-disputed project.

The developer has revised the size, scope, height, and design of the project repeatedly.

On Friday, GoLocal requested copies of the documents and the 195 Commission’s outside public relations consultant Cara Cromwell wrote in response to the request, “I am not going to have anything to share. Your best bet is to ask Fane for copies of that they submitted.”

GoLocal asked for a written explanation as to why the documents submitted Friday are being withheld and under what exemption of Rhode Island open records law.

The Commission refused to respond to the request.

Fane’s spokesman Jim Malachowski said that the 195 Commission is the public body of record and said the Commission had the responsibility to release the documents.

Over the four-year process, requests for documents have always been provided by the Commission and Fane.

The Fane project was first proposed in November of 2016 and has missed multiple deadlines.

Chair of the 195 Commission Robert Davis came under criticism in November for conducting nearly all of the board’s November meeting reviewing Fane’s proposal behind closed doors.

Between the tax stabilization agreement, special legislation approved by the Rhode Island general assembly, and incentives provided by the Rhode Island Commerce Corporation, the project is receiving nearly $100 million in public subsidies.
