Following a July 14 meeting between the accuser, his parents and prosecutors, the charges against Kevin Spacey have been dropped by prosecutors. In a statement, District Attorney Michael O’Keefe said the accuser chose to invoke the Fifth Amendment on July 8, which ultimately halted the case’s progression. 

Michael O’Keefe, via a statement, said Spacey was first accused of sexual assault in 2017 by an 18-year-old boy who alleged that the actor groped him in 2016 while at a bar in Nantucket, Massachusetts. In January 2019, Spacey was formally charged with indecent assault and battery stemming from the accusation. The alleged victim reportedly took videos of the assault, but during the pre-trial hearings it was discovered that key information on the phone had been deleted. It was also revealed that the accuser’s phone had apparently been lost in the process of forensic examination. 

The accuser then voluntarily chose to dismiss the case with prejudice, meaning he cannot refile the case at a later date.

"My client and his family have shown an enormous amount of courage under difficult circumstances.  I have no further comment at this time," said Attorney Mitchell Garabedian in a statement to GoLocal.
