Fired Teacher Suing City To Get Job Back

A half-decade long battle between a former teacher and the city of Providence could reach its conclusion in September, GoLocalProv has learned.

Bernard McCrink, who taught mathematics and coached track at Mount Pleasant High until May of the 2005/06 school year before he was placed on paid suspension and then terminated by the Providence School Board the following September, is suing the city in order to return to work and collect the wages that he would have received over the past five years.

McCrink was fired after the School Board determined he had failed to notify the school of his absence or to leave written material for a substitute teacher on May 16, 2006. The Board claims it had the right to terminate him based on a laundry list of prior disciplinary issues and claims over the course of his tenure at the school, which include using a racial slur in class, a student visiting explicit websites on his computer and accusations that he bribed his students.

But sources close to McCrink say the school and the School Department began a “witch hunt” following his 2006 suspension, digging up every claim ever made against the teacher in an attempt to have him removed permanently.

Allegations: Slurs/Porn/Bribes/Exotic Dancing

McCrink, who was known as an outspoken critic of both Mount Pleasant and the School Department, has had several serious allegations made against him since he started teaching at the school in 1993. In one instance in the ‘90s, he allegedly used the word “nigger” in class, for which he received a letter of reprimand. This claim also appears in a 2009 ruling by Education Commissioner Deborah Gist to uphold his termination.

In another instance, the School Board claimed that McCrink failed to provide “adequate supervision of computer use in his classroom, with the result that a student accessed pornography during his Algebra II class,” according to the 2009 report. The School Department also hired an “expert” to analyze McCrink’s hard drive and the expert found that pornography had been accessed on three separate dates under his computer account.

In the 2009 ruling to uphold the termination, the School Board also claimed that McCrink may have used language that suggested he would take bribes from students in exchange for good grades: “Although there was no evidence that Mr. McCrink actually solicited bribes from students in return for passing grades or excuses from class, the district argues that there is evidence that he would ‘joke’ with students about doing so,” the report states. “The Appellant testified that he would joke with students that they would need a lot of money in order to pay for a passing grade unless they ‘got their act together’ and stopped ‘goofing up.’”

In a final instance of what could be viewed as inappropriate conversation with students, McCrink allegedly “would tell ‘funny stories’ involving a friend of his who had been ‘in the porn business’ at one time." McCrink maintained, and two witnesses verified, that he had warned against exotic dancing being a good career choice.

McCrink’s Side Of The Story

The lawyer representing McCrink, State Representative John DeSimone, did not wish to comment for this story. But speaking on the condition of anonymity, a source close to McCrink said the School Board had acted on “fabricated information that was 100 percent totally false.”

In the 2009 report, McCrink offered his response to all of the allegations made against him. DeSimone argued that his dismissal was “beset by procedural flaws” and filled with unsupported allegations.

On the pornography incident: “The School Board’s computer forensics expert was given a directive to inspect the computer’s hard disc and locate pornographic activity during the times that Mr. McCrink was teaching in his classroom,” McCrink’s side argued. “He was able to identify only one student who had accessed pornography, and although he concluded that the student had accessed pornographic material during Mr. McCrink’s fourth-period class, this was the result of a mistake he made in calculating the time.”

The alleged bribery was also unsubstantiated, DeSimone said in the 2009 report. The source close to McCrink called the incident a “joke that happens with every teacher in every classroom all the time.”

As far as the exotic dancing comment, “Mr. McCrink and two students did testify that when the subject of exotic dancing came up, it was raised by a student or students, and Mr. McCrink merely discouraged the notion of getting involved in such activity,” the report said.

Commissioner Upheld School Board Decision

In the end, Commissioner Gist upheld the School Board’s decision to terminate McCrink, but it wasn’t because of the alleged indecent incidents the School Board detailed.

“As indicated in our Findings of Relevant Facts, the School Board has proven that on May 16, 2006 Mr. McCrink failed to report his absence or provide written materials for a substitute teacher,” the ruling stated. “The Board did not meet its burden of proving by a preponderance of the evidence the other grounds on which it had sustained Mr. McCrink’s dismissal.”

The decision goes on to suggest that that School Board had “good and just” reasons to fire McCrink. Gist ruled that his conduct disrupted the educational environment at the school and that he failed to provide written material for substitutes when he was out of work.

The source close to McCrink says the teacher had an episode related to an ongoing heart ailment preceding his alleged failed call out on May 16, 2009. But the report said his explanation for failing to call out on was “implausible.”

Judge Will Likely Make Decision In September

Following the decision, McCrink chose to take his case to Superior Court. In the nearly two years that has followed, the case has been assigned to three different judges and has stalled on numerous occasions.

On July 6, the matter was assigned to Judge Susan McGuirl for decision. It is now being analyzed by law clerks before a ruling is rendered sometime in September.

For McCrink, that means another school year will begin with him not in a classroom.

As an outspoken union member I have been subject to the same tactics and you cant believe every thing student say, they to might have there own agendas. Looks to me like most of what this guy said has been taken out of context. I'm going to guess that most of what he said was within the context of humor and that he was merely trying to keep the students engaged...students whose attention very likely needed to be actively managed.

As far as someone looking at porn on the computer at school, why wasn't the system administrator held accountable instead? Giving students blanket access to the worldwide web is like handing them a loaded gun, asking them to become familiar with it, and then being surprised that someone got shot. Don't hold the teacher accountable. Hold the administration accountable for providing the guns and then making them part of the curriculum.

Oh and just for the record, I agree if the allegations were true he should be fired, but like I said they were dismissed by the dept. of ed., that should tell you something about the case, no evidence. Everyone is entitled to there day in court.

Anyone who has ever worked with teens know that these topics come up all the time. The kids love to talk about their goal of becoming a stripper--mostly the males brag like that. Kids jokingly offer bribes to teachers all the time. I think that it is amazing that given the low security on the system, only one kid was able to access porn. Seriously, Ms. Gist, these are high school kids not elementary. Have you watched MTV lately?

Again, most of what has been outlined in this article seems to point toward comments taken out of context. I went to high school. I had teachers. Many of them, thankfully, were willing to bring a human element to their teaching. I'm sure if we try, we can gradually litigate the human element out of the learning experience and our kids can become even further incapable of exercising judgement or applying fuzzy logic. They can all grow up inside the box, afraid to bring anything to the table that hasn't been blessed by the legal system.

It looks to me, from what is in this article (and I have no other info beyond what is in this article) that this teacher is being punished for possibly having a sense of humor.

#2...where does it state formally that RIDE "laughed out" anything...you could/would know that if you were in such hearings which based on the nature of the case would be held CLOSED session or Bernard told you that??..thats it Bernard has made a major effort to defend himself..he may have thought 8X about using john DeSimone unless he slipped & fell..DeSimone is there because of steve smith certainly not due to expertise, professionalism or ability..the only worse atty would be his brother Thomas desimone ..I am sure deb gist is losing much sleep over this..she ruled..suck it up!!

I think its funny to sit here and read all the bad month comments made by people who dont even know this man or the full story fortunatly i do i know him as one of my teachers from high school 06 he is a great teacher who cared about the students who wanted to be there he helped me graduate get my high school diploma and many others all i can tell you is it wasnt from bribes/slurrs or any other allgation made by the school bord it was from being there as a teacher/roll modle helping students with work/extra credit/ retaking test etc. the school bord is just upset because they were full of hot air and it blew up in there face I know everyone is intitled to thier own opinion but read the facts and listen to the people who were actually there in the class room the only thing he may be guilty of is being out spoken and not standing for the Bs these school officals are trying to pull I hope he dose win his case and he moves on to teach many other young people .....

I love how people are judging him without even knowing him... I was one of his students and can honestly say what these people are saying about him is complete bull. I have seen all of the tension between him and my ex principal. He was.. no "is" a good teacher.. Yes he would kid around about the money for grades thing, but if you were in his class you can honesty see that he was kidding, especially when he would say "not all the money i the world can allow you to pass" Give a good teacher his job back.. these kids need more teachers like him.

I teach in Prov too and kids ask me every year if they can pay me to pass them. I tell them this HUGE amount and then ask for a house in Malibu to top it off... EVERYONE knows we are not serious.
I also cannot tell you the countless times I have left lesson plans on my desk and they have disappeared, or have not been used and they are in plain view. I have also called them in and they have not gotten to where they were supposed to go.
As for the porn, in the early 2000s no matter what you clicked on a porn pop up or banner would come up. Since then, they have put better blocks on this. This student that was looking at porn in my friend's room was doing it during lunch.
Also, being a Prov school teacher, I certainly know how certain admins can have it out for you if they don't like you. I've seen it many times and have been the victim of it as well. Fortunately now, I am in a school with really nice administrators that are hard working and help teachers and students.

Mr. McCrink was a very caring person towards his students. I know because I too was his students back in 2000. I passed his class with an A because he would make himself available for tutoring after school. Not once did bribery come up, so how they got that idea was beyond me. He should not be punished for being an outspoken teacher. Providence need teachers like him who actually cares about the students education and not just show up to get paid! Its sad how people are bad mouthing him when they have not walked in his shoes!

I was one of Mr. McCrink’s students back in 2003 at Mount Pleasant High School, Algebra II and Precalculus class. He was nothing but a great educator. His love for his career was noticeable. He would always come in to work an hour early just to make himself available for any students like me who often had questions on homework. He would stay an hour later just to help with any questions or concerns I‘d have regarding the assignments. He would go above and beyond for all his students. I never for once felt he left me behind. He was always there with a helping hand and a friendly smile when I was confused on my homework. He was always very encouraging and patient towards my learning. He puts his love for teaching in front of everything so people like me can have a brighter future.
I know that in the past he was out of work due to his heart condition, but that didn’t stop him from submitting his lesson plans. In fact, he was always there for his students when he was at his worst. I remembered sitting in class the first day he came back from his illness. I can tell he was not feeling his best still he stood up in class and taught us math. He continued to come in to work an hour early everyday to make himself available for extra help and stayed an hour later to make sure students like me understood how to do our assignments. This is the kind of teacher that Providence needs. Providence needs teachers like Mr. McCrink who cares for his students’ learnings and his love to teach.

Der, At first read, I asked myself why this teacher would want to go back there? Now that I have read your post I understand.
From what I have read, it seems that Mr.McCrink has his problems but was still able to reach and teach his classes.
I think that it is unfortunate that students like you and those in Central Falls have to witness the slanderous treatment of their beloved teachers.

I had Mr Mccrink as a teacher 2 of my 4 years at school and he was my favorite teacher. I might not hav passed math without his help. Like others said, he was always there early to give help, He also helped me get a part-time job while i was in school and taught golf to kids and stuff like that. he had health problems and I liked him so much I visited him with another student when he got operated on. He is what the schools need because he cares more about his students than anyone else i see.
