Over 50 people became ill, 26 were hospitalized, and one died after the zeppole salmonella food poisoning episode that occurred around St. Joseph’s Day in Rhode Island in mid-March. Now the legal action has begun.

A lawsuit will be filed by attorneys at the Boston law firm of Cooley Manion Jones on behalf of the parent of an unidentified minor boy against DeFusco’s Bakery Inc., the prime suspect in the series of incidents, after the child allegedly became ill after eating two of the company’s zeppoles.  The symptoms described in the suit were abdominal cramping, diarrhea and fever.

Medical care was required, the suit claims, and a stool sample was taken which confirmed the salmonella.  The lawsuit asks for unspecified damages for both the mother and her son for loss and damages.

The Rhode Island Department of Health announced a recall of DeFusco’s zeppoles on March 25.  The bakery’s zeppoles were also sold to American Bakery Supplies, a West Warwick-based distributor which in turn sold them to other food retailers in Rhode Island. DeFusco’s has reportedly shut down for the time being.

The cause of the outbreak was raw egg contamination of the pastry shells. The Department of Health said the pastry shells used to make the zeppoles were stored in egg crates, where they most likely came into contact with the eggs.
