RWU Law Professor Goldstein Gives Insights into Supreme Court Nominee Kavanaugh

Roger Williams University Professor of Law Jared Goldstein joined GoLocal News Editor Kate Nagle on GoLocal LIVE to discuss President Donald Trump’s nomination of Judge Brett Kavanaugh to the United States Supreme Court — and broke down what Kavanaugh has said so far regarding his views on the Constitution.
“They all say they’ll follow the constitution, they’re dedicated to the rule of law — and you could hear him repeat what Justice Roberts says, the role of the judge is like the umpire in baseball, they don’t make the rules, they just call the balls and strikes — which is an appealing metaphor that they’re not applying their own ideas they’re just calling balls and strikes,” said Goldstein. “That metaphor is so far from what Chief Justices actually do.”
“It’s not like a ball and strike, [where] at least there’s a basic rule,” said Goldstein. “With the Constitution and law there’s no box, there’s broad language — equal protection for all and free speech — which is up to the justices.”
